Please read these terms carefully before using Häuses. By using our Service, you agree to be bound by these terms.

Acceptance of Terms
By accessing and using Häuses ("Service", "Platform", "we", "us", "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and Häuses Platforms (Canada) Limited, a corporation incorporated under the laws of Ontario, Canada, with its registered office at 100 King Street West, Suite 5700, Toronto, ON M5X 1A9.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to your registered address. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
Service Description
Häuses is a property management platform that provides:
**For Landlords:**
- Property and tenancy management
- Automated rent collection via Stripe, Pre-Authorized Debit (PAD), and Interac e-Transfer
- Document storage and provincial compliance tracking
- N-form notice generation and LTB/RTB procedure guidance
- Maintenance tracking and contractor management
- Financial reporting and analytics
- Tenant communication tools
- Atlas AI — trained on provincial tenancy legislation
**For Tenants:**
- Rent payment processing (card, PAD, and Interac e-Transfer)
- Digital lease agreement signing
- Maintenance issue reporting
- Document access and storage
- Landlord communication
- Atlas AI Home Assistant mode for tenant rights guidance
**For Property Management Teams:**
- Multi-property portfolio management
- Team member access and permissions
- Managed landlord portal access
- Advanced reporting and analytics
- API access (on Team+ and Enterprise plans)
- Atlas AI Co-Director mode
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
Account Registration & Eligibility
**Eligibility**
You must be at least 18 years old to use Häuses. By registering, you represent that:
- You are of legal age to form a binding contract under the laws of your province of residence
- All information provided is accurate and current
- You will maintain the accuracy of your information
**Account Security**
You are responsible for:
- Maintaining the confidentiality of your password
- All activities under your account
- Notifying us immediately of unauthorized access
- Using a strong, unique password
- Enabling two-factor authentication (recommended)
**Account Termination**
We may suspend or terminate your account if:
- You violate these Terms
- Your account is used fraudulently
- You fail to pay applicable fees
- As required by law or court order
You may close your account at any time from your account settings.
Pricing & Payment Processing Fees
Subscription Pricing (Canadian Dollars)
All prices are in Canadian dollars (CAD) and are exclusive of applicable taxes (GST/HST).
**For Landlords:**
- Essential (up to 3 properties): C$34.99/month
- Landlord (up to 10 properties): C$49.99/month
- Portfolio (up to 25 properties): C$79.99/month
- Enterprise (unlimited): Custom pricing
Annual billing is available at a 20% discount on all plans.
**For Teams/Agencies:**
- Growth (up to 25 properties): C$44.99/member/month
- Team+ (up to 100 properties): C$79.99/member/month
- Enterprise (unlimited): Custom pricing
Minimum 2 team members required on Growth and Team+ plans.
Payment Processing Fees
In addition to subscription fees, payment processing fees apply to rent transactions:
**Pre-Authorized Debit (PAD):**
- All plans: 1% per transaction
**Stripe Card Payments:**
- All plans: 2.9% + 30¢ per transaction
**Interac e-Transfer:**
- No additional processing fee (standard Interac fees may apply to sender)
**Important Notes:**
- Payment processing fees reflect the actual cost of payment processing — we do not mark them up
- Fees are deducted automatically from each transaction
- No processing fees apply to subscription billing
- All fees are exclusive of GST/HST where applicable
- HST (13%) applies to subscription fees for Ontario customers
- GST/HST rates vary by province and will be applied based on property location
**Billing Terms**
- Subscriptions are billed monthly or annually in advance
- Payment processing fees are deducted per transaction
- All fees are non-refundable except as required by law or as described in our refund policy
- Prices may change with 30 days' notice
- Failed payments may result in service suspension
Free Trial
14-Day Free Trial
New users receive a 14-day free trial with:
- Full access to all plan features
- No credit card required to start
- Ability to add properties and invite tenants
- Test payment processing (test mode)
**After Trial Period:**
- You will be prompted to add payment details
- Service continues if payment information is added
- Service is suspended if no payment information is provided
- Data is retained for 30 days after suspension
- After 30 days, data may be permanently deleted
**Trial Limitations:**
- One trial per email address
- One trial per company/organization
- We reserve the right to refuse trial access
User Responsibilities
**Landlords Must:**
- Provide accurate property information
- Comply with the Residential Tenancies Act, 2006 (Ontario) or applicable provincial tenancy legislation
- Serve proper notice using the correct N-form or provincial notice form
- Follow rent increase guidelines and obtain required approvals for above-guideline increases
- Respond to tenant maintenance requests within reasonable timeframes
- Comply with all applicable municipal, provincial, and federal laws
- Provide accurate bank details for rent disbursement
- Maintain adequate insurance for properties
- Collect and remit applicable taxes as required by the Canada Revenue Agency (CRA)
**Tenants Must:**
- Provide accurate personal information
- Make rent payments on time
- Report maintenance issues promptly
- Comply with lease agreement terms
- Not sublet or assign without landlord consent as required by the RTA
- Maintain contents insurance (recommended)
**All Users Must:**
- Not use the Service for illegal purposes
- Not attempt to access unauthorized areas
- Not interfere with Service operations
- Not upload malicious code or viruses
- Not impersonate others
- Not harass other users
- Comply with PIPEDA and applicable privacy legislation
- Comply with Canada's Anti-Spam Legislation (CASL) when using communication features
Rent Collection & Disbursement
**Payment Processing**
- Rent payments are processed via Stripe (cards), Pre-Authorized Debit (PAD), or Interac e-Transfer
- Häuses acts as a technology facilitator, not a money transmission service
- Funds are held by payment processors, not by Häuses
- We are not responsible for payment processor errors or delays
**Disbursement Schedule**
- Card payments: 2 business days to landlord's Canadian bank account
- Pre-Authorized Debit: 3 business days after collection
- Interac e-Transfer: Instant with auto-deposit enabled
- All times are approximate and subject to payment processor schedules
**Failed Payments**
- Tenants are notified immediately of failed payments
- Landlords are notified of failed payments
- Automatic retry for PAD (managed by the PAD processor)
- Late payment fees are between landlord and tenant and must comply with the applicable provincial tenancy act — Häuses does not facilitate or enforce late fees
**Disputes & Chargebacks**
- Payment disputes are handled by Stripe or the PAD processor
- We may suspend Service during dispute resolution
- Users must cooperate with dispute investigations
- Fraudulent chargebacks may result in account termination
**Last Month's Rent Deposit**
- In Ontario, landlords may collect a last month's rent deposit (not a security deposit)
- Häuses can track deposit amounts and interest owing under the RTA
- Landlords are responsible for applying the deposit correctly at tenancy end
Atlas AI
**Atlas AI Service**
Atlas AI is an artificial intelligence feature that provides guidance on provincial tenancy legislation, compliance procedures, and property management. Atlas AI is trained on jurisdiction-specific legislation including Ontario's Residential Tenancies Act, 2006.
**Not Legal Advice**
Atlas AI provides informational guidance only. Atlas AI output does not constitute legal advice, and should not be relied upon as a substitute for advice from a qualified lawyer, licensed paralegal, or other professional. You should independently verify any information provided by Atlas AI before acting on it.
**No Guarantee of Accuracy**
While we make every effort to keep Atlas AI's training data current and accurate, we do not guarantee that Atlas AI output is complete, current, or free of errors. Provincial legislation and tribunal procedures change regularly, and there may be a delay between a legislative change and Atlas AI's training data being updated.
**Your Responsibility**
You are solely responsible for decisions made using Atlas AI guidance. Häuses is not liable for any loss, damage, or legal consequence arising from reliance on Atlas AI output, including but not limited to improperly served notices, missed deadlines, or incorrect compliance advice.
**Provincial Coverage**
Atlas AI is currently trained on Ontario legislation. As Häuses expands to additional provinces, Atlas AI will be trained on each province's specific tenancy legislation. Atlas AI will clearly indicate which jurisdiction its guidance applies to.
Documents & Data
**Document Storage**
- Documents are stored in secure, encrypted cloud storage in Canadian data centres (AWS Montreal)
- Maximum file size: 10MB per document
- Supported formats: PDF, JPG, PNG, DOCX, XLSX
- Storage is provided "as is" with no guarantee of permanence
**User Content Ownership**
- You retain all rights to content you upload
- You grant us a licence to store, process, and display your content as necessary to provide the Service
- This licence ends when you delete content or close your account
**Document Retention**
- Active account: Documents retained while account is active
- Closed account: Documents retained for 7 years (CRA requirement for financial records)
- Lease-related documents retained for 6 years after tenancy ends (Ontario Limitations Act, 2002)
- You can download all documents before closing your account
**N-Form Notices and LTB Documents**
- N-form notices generated by Häuses are based on templates that reflect current Ontario RTA requirements
- Users are responsible for verifying accuracy and proper service of all notices
- Häuses retains copies of generated notices for your records
- LTB filing documents are the user's responsibility to file correctly
Intellectual Property
**Häuses IP**
All rights, title, and interest in the Service, including:
- Software and source code
- Trademarks, logos, and branding
- Design elements and user interface
- Documentation and help content
- Atlas AI models and training data
- Proprietary algorithms and features
These are owned by Häuses Platforms (Canada) Limited and protected by Canadian copyright, trademark, and other intellectual property laws.
**Restrictions**
You may not:
- Copy, modify, or distribute the Service
- Reverse engineer or decompile the software
- Remove copyright or proprietary notices
- Use our trademarks without permission
- Create derivative works
- Scrape, mine, or extract data from Atlas AI for use in competing products
**User Content Licence**
By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to:
- Store and backup your content
- Display content to authorized users
- Process content to provide Service features
- Analyze content for Service improvement (anonymized and aggregated only)
This licence ends when you delete content or close your account.
Third-Party Services
We integrate with third-party services:
**Payment Processing**
- Stripe (card payments) — stripe.com/en-ca/legal
- PAD processor — for Pre-Authorized Debit rent collection
- Interac e-Transfer — via your financial institution
**Infrastructure**
- AWS (Canadian region, ca-central-1) — Cloud hosting
- Resend — Email delivery
**Use of Third-Party Services**
- You agree to their respective terms of service
- We are not responsible for third-party service issues
- Service disruptions may occur if third-party services fail
- We may change third-party providers with reasonable notice
**Third-Party Links**
The Service may contain links to external websites. We are not responsible for:
- Content on third-party sites
- Privacy practices of third-party sites
- Transactions with third-party sites
Warranties & Disclaimers
**Service Provided "As Is"**
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of content
**No Legal, Tax, or Financial Advice**
Häuses is a software platform, not a legal, tax, or financial advisory service. We do not provide:
- Legal advice (including Atlas AI output — see Atlas AI section)
- Tax advice
- Financial advice
- Property management advice
- Compliance guarantees
Consult qualified professionals — including Ontario-licensed lawyers and paralegals — for legal, tax, and financial matters.
**Compliance Responsibility**
You are solely responsible for:
- Complying with all applicable federal, provincial, and municipal laws
- Complying with the Residential Tenancies Act, 2006 (Ontario) or equivalent provincial legislation
- Obtaining required licences and permits
- Properly serving notices with correct timelines and grounds
- Filing with the Landlord and Tenant Board or equivalent provincial tribunal correctly and on time
**Platform Availability**
We strive for 99.9% uptime but do not guarantee:
- Continuous availability
- Error-free operation
- Freedom from viruses or malware
- Compatibility with all devices
- Prevention of unauthorized access
We may perform maintenance that temporarily interrupts Service.
Limitation of Liability
**Liability Cap**
To the maximum extent permitted by applicable Canadian law, Häuses's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service is limited to:
- The total amount paid by you to Häuses in the 12 months immediately preceding the event giving rise to the claim, or
- C$100, whichever is greater
**Excluded Damages**
To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or business
- Loss of data or content
- Loss of goodwill or reputation
- Cost of substitute services
- Damages arising from third-party services
- Acts or omissions of other users
- Damages arising from reliance on Atlas AI output
- Damages arising from improperly served notices or missed compliance deadlines
**Exceptions**
These limitations do not apply to:
- Liability that cannot be excluded or limited under applicable Canadian or Ontario law
- Fraud or fraudulent misrepresentation by Häuses
- Häuses's gross negligence or wilful misconduct
**Indemnification**
You agree to indemnify and hold Häuses Platforms (Canada) Limited, its officers, directors, employees, and agents harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of third-party rights
- Content you upload to the Service
- Your use or misuse of the Service or Atlas AI
Termination
**Termination by You**
You may cancel your subscription at any time from account settings:
- Cancellation takes effect at end of current billing period
- No refunds for unused time in the current billing period
- Access continues until end of billing period
- Data retained for 30 days after cancellation
- After 30 days, data may be permanently deleted (subject to legal retention requirements)
**Termination by Us**
We may suspend or terminate your account immediately if:
- You materially violate these Terms
- Your account is used fraudulently
- You fail to pay fees after reasonable notice
- We are required to do so by law or court order
- You engage in conduct harmful to other users or the Service
**Effect of Termination**
Upon termination:
- Your access to the Service ends at the end of the billing period (or immediately in cases of material breach)
- Outstanding fees become due immediately
- We may delete your data after the applicable retention period
- Provisions that should survive termination (including limitation of liability, indemnification, and dispute resolution) remain in effect
- No refunds for prepaid fees except as required by applicable law
**Data Export**
Before cancellation, you can export:
- All property and tenancy data (CSV, JSON)
- Financial reports (PDF, Excel)
- All documents including generated N-form notices (ZIP download)
Download your data before cancellation, as access ends at the end of your billing period.
Dispute Resolution
**Governing Law**
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
**Jurisdiction**
You agree to the exclusive jurisdiction of the courts of the Province of Ontario, located in Toronto, for any disputes arising out of or relating to these Terms or the Service.
**Informal Resolution**
Before commencing any formal proceedings, you agree to contact us at legal@hauses.ca to attempt informal resolution in good faith. We commit to respond within 10 business days and to make good-faith efforts to resolve disputes informally.
**Mediation**
If informal resolution is unsuccessful within 30 days, either party may refer the dispute to mediation administered by the ADR Institute of Ontario. The mediation shall take place in Toronto, Ontario and be conducted in English.
**Arbitration**
If mediation is unsuccessful, disputes may be resolved through binding arbitration under the Arbitration Act, 1991 (Ontario), administered by the ADR Institute of Ontario. The arbitration shall take place in Toronto, Ontario.
**Exceptions**
Either party may seek injunctive or other equitable relief from the Ontario Superior Court of Justice without first pursuing informal resolution, mediation, or arbitration.
**Consumer Rights**
Nothing in this dispute resolution section limits any rights you may have under the Ontario Consumer Protection Act, 2002, or other applicable consumer protection legislation.
General Provisions
**Entire Agreement**
These Terms, our Privacy Policy, and any additional agreements or policies referenced herein constitute the entire agreement between you and Häuses Platforms (Canada) Limited regarding the Service.
**Severability**
If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
**Waiver**
Failure by Häuses to enforce any provision of these Terms does not waive our right to enforce it later.
**Assignment**
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets, provided the successor agrees to be bound by these Terms.
**Force Majeure**
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labour disputes, internet or telecommunications failures, or utility outages.

We will send notices to your registered email address. Notices are deemed received 24 hours after email is sent, or 3 business days after posting by regular mail.
**Language**
These Terms are drafted in English. If these Terms are translated into any other language, the English version shall prevail in the event of any inconsistency.
**Consumer Protection**
Nothing in these Terms is intended to exclude or limit any rights you may have under the Ontario Consumer Protection Act, 2002, or other applicable consumer protection legislation that cannot be excluded or limited by contract.
